TRANSFERS OF FUNCTIONS UNDER THE CREMATION ACTS 1902 AND 1952

ENGLAND AND WALES

1919

The functions of the Local Government Board under Cremation Act, 1902, were transferred to the newly created Minister of Health by Ministry of Health Act, 1919 (c. 21), s. 3(1)(a). S. 5 of that Act allowed the Minister to establish a Board of Health in Wales through whom to perform such of his functions as he thought fit.

1951

The functions of the Minister of Health under the Cremation Act, 1902, were transferred to the Minister of Local Government and Planning on 1 May 1951 by The Transfer of Functions (Minister of Health and Minister of Local Government and Planning)(No. 2) Order, 1951 (S.I. 1951/753) art. 2(1). On 3 November 1951 the name of the Minister of Local Government and Planning was changed to the Minister of Housing and Local Government by The Minister of Local Government and Planning (Change of Style and Title) Order, 1951 (S.I. 1951/1900).

1965

The functions of the Minister of Housing and Local Government under the Cremation Acts 1902 and 1952, in so far as those Acts applied to Wales, were transferred on 1 April 1965 to the Secretary of State for Wales by The Secretary of State for Wales and Minister of Land and Natural Resources Order, 1965 (S.I. 1965/319) art. 2(1)

1970

The functions of the Minister of Housing and Local Government under the Cremation Acts 1902 and 1952 were transferred to the Secretary of State by The Secretary of State for the Environment Order, 1970 (S.I. 1970/1681) art. 2(1)

1999

The functions of the Secretary of State for Wales under the Cremation Act 1952 were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) art 2 and Schedule 1, made under the Government of Wales Act 1998.

2005

The functions of the Home Secretary were transferred to the Department for Constitutional Affairs. (No Statutory Instrument or Order-in-Council was required for this. The transfer was announced in a press notice released by the Cabinet Office on 23 May 2005.)

2007

The functions of the Department of State for Constitutional Affairs were transferred to the Ministry of Justice on 9 May 2007. (No Statutory Instrument or Order-in-Council was required for this. SCOTLAND

1919

The functions of the Local Government Board for Scotland under the Cremation Act, 1902, were transferred to the newly created Scottish Board of Health by Scottish Board of Health Act, 1919, s. 4(1)(a).

1926

The functions of the Secretary for Scotland under the Cremation Act, 1902, were transferred to the newly created Secretary of State for Scotland by the Secretaries of State Act, 1926,

1928

The functions of Scottish Board of Health under the Cremation Act, 1902, were transferred to the newly created Department of Health for Scotland by Reorganisation of Offices (Scotland) Act, 1928, s. 1(1) and the Department of Health for Scotland (Consequential Provisions) Order, 1928 (S. R. & O. 1938 No 959/S.51).

1939

The functions of the Department of Health for Scotland under the Cremation Act, 1902, were transferred to the Secretary of State for Scotland by the Reorganisation of Offices (Scotland) Act, 1939, s. 1(1).

1998

The functions of the Secretary of State for Scotland under the Cremation Act, 1902, were transferred to Scottish Ministers by the Scotland Act, 1998, s. 53.
